These Terms of Service ("Terms") are a binding agreement between you and SevenHills Software, the company behind VisibilityKit ("VisibilityKit," "we," "our," or "us"). They govern your access to and use of the VisibilityKit products: our website, the VisibilityKit Intelligence web application, the VisibilityKit Crawler desktop application, our APIs and related services (collectively, the "Service").
By accessing or using the Service, you agree to these Terms, along with our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Service.
VisibilityKit has three products.
VisibilityKit Intelligence is a web application that measures how often your brand is mentioned, recommended and cited by AI assistants such as ChatGPT, Perplexity, Gemini and Google AI Overviews when buyers ask category questions. It lets you:
VisibilityKit Crawler is a desktop application for macOS, Windows and Linux that audits websites you have the right to crawl. It finds technical issues, tracks fixes and re-checks them, and includes an MCP server so an AI client on your computer can drive crawls. Crawl data is stored on your own computer. The Crawler does not measure AI citations; that is what Intelligence does.
Visibility Tracker is website analytics for the AI-search era. You add a tracking script (and optionally a server-side snippet) to websites you control, and it shows pageviews, visitors, referrers, custom events, visits that arrive from AI assistants and requests from AI crawlers. While Visibility Tracker is in early access, availability, features and limits may change.
We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.
To use most features of the Service, you must create an account. You agree to:

The Crawler does not require an account. Its free tier works without one, and paid tiers are unlocked with a licence key (see section 5.5).

The Crawler fetches pages from websites you point it at. You are responsible for making sure you have the right to crawl those sites, for respecting their robots.txt and rate limits, and for complying with the laws that apply to you. Do not use the Crawler against sites you do not own or have permission to audit. Any API keys or credentials you enter into the Crawler are yours; you are responsible for their use and for the provider's terms.

For the analytics data collected from your visitors, you are the data controller and we process it on your behalf as described in our Privacy Policy (section 2.6). Data is kept for your plan's retention period and deleted when you remove a site or close your account. Plan limits (such as monthly events and number of domains) apply; events beyond your limit may not be recorded.
VisibilityKit Intelligence is sold as a monthly subscription in Free, Individual, Marketer and Agency plans. Current prices, what each plan includes and any usage limits are published on our pricing page, which forms part of these Terms. We may change pricing with at least 30 days' notice for existing paid subscribers.
We may offer free trials at our discretion. Unless you cancel before the trial ends, your account will automatically convert to a paid subscription at the listed price when the trial expires.
Listed prices exclude applicable taxes (VAT, GST, sales tax, etc.). Lemon Squeezy may collect taxes on our behalf where required by law. You are responsible for any taxes that apply to your purchase.
You can cancel a monthly subscription at any time from your account settings. We generally do not provide refunds for partial months, but we may offer a pro-rated refund at our discretion if you cancel within 7 days of a billing date and have not used the Service substantially during that period.
Annual subscriptions may be refunded within 14 days of purchase if you have not used the Service extensively. After 14 days, annual subscriptions are non-refundable, but you may continue to use the Service through the end of your billing period.
The free tier lets you run real audits before you buy, so Crawler licence purchases are final once the licence key has been activated, except where the consumer law that applies to you requires otherwise. If a licence does not work as described, contact support and we will put it right or refund it.
To request a refund, email us at support@visibilitykit.app from the email address on your account. Approved refunds are processed via Lemon Squeezy and typically appear within 5–10 business days.
The Service, including its software, content, design, and underlying technology, is owned by SevenHills Software and protected by copyright, trademark, and other intellectual property laws. The names "VisibilityKit" and "SevenHills Software," along with related logos, are our trademarks.
You keep ownership of any content you submit to the Service (such as brand names, domains, prompts, and competitor lists). By submitting that content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display it solely to provide and improve the Service for you.
Crawl data produced by the Crawler is created and stored on your own computer. We do not receive it and claim no rights over it.
If you send us feedback, suggestions, or feature requests, we may use them to improve the Service without any obligation or compensation to you.
To deliver Intelligence reports, VisibilityKit sends queries to third-party AI platforms (including ChatGPT, Perplexity, Gemini and Google AI Overviews) on your behalf and analyzes the responses. Integrations you configure in the Crawler, such as Google Search Console or an AI provider, use your own credentials and are governed by that provider's terms.
We do not control these AI platforms. Their availability, behavior, and outputs change over time, sometimes without notice. As a result, results may vary, and historical data points may not be exactly reproducible. We are not responsible for the content, accuracy, or availability of third-party AI platforms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
We do not guarantee that AI platforms will cite, recommend, or even mention your brand, or that using the Service will produce any particular business outcome. AI platforms decide what to say; we measure and analyze their output.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER VISIBILITYKIT NOR SEVENHILLS SOFTWARE SHALL BE LIABLE FOR:
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless VisibilityKit, SevenHills Software, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
You may cancel or close your account at any time from your account settings, or by contacting us. Cancellation does not entitle you to a refund except as described in our Refund Policy.
We may suspend or terminate your account if you:
When your account ends, your right to use the Service ends immediately. We may delete your account data within 30 days of termination, except where we are required to retain it by law or to resolve a dispute. See our Privacy Policy for more on data retention. Closing a VisibilityKit account does not revoke a Crawler licence you have paid for.
Before filing a formal dispute, please email us at legal@visibilitykit.app and attempt to resolve the issue informally for at least 30 days. Most issues can be sorted out this way.
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law principles.
Any dispute that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court. Each party will bear its own costs except as the AAA rules or applicable law require otherwise.
These Terms, together with our Privacy Policy, Cookie Policy, and any other legal notices we publish on the Service, make up the entire agreement between you and VisibilityKit.
If any part of these Terms is found unenforceable, the rest will remain in full effect.
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations (for example, in connection with a merger, acquisition, or sale of assets) without restriction.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or via the Service. Your continued use of the Service after the changes take effect means you accept the updated Terms.
