These Terms of Service ("Terms") are a binding agreement between you and SevenHills Software, the company behind VisibilityKit ("VisibilityKit," "we," "our," or "us"). They govern your access to and use of the VisibilityKit platform, including our website, dashboards, APIs, and related services (collectively, the "Service").
By accessing or using the Service, you agree to these Terms, along with our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Service.
VisibilityKit is an AI Engine Optimization (AEO) platform. We help businesses understand and improve how often their brand is cited by AI assistants when their buyers ask category questions. Specifically, the Service lets you:

VisibilityKit currently offers the following plans:
Plan details and any usage limits are available on our pricing page. We may change pricing with at least 30 days' notice for existing paid subscribers.
We may offer free trials at our discretion. Unless you cancel before the trial ends, your account will automatically convert to a paid subscription at the listed price when the trial expires.
Listed prices exclude applicable taxes (VAT, GST, sales tax, etc.). Lemon Squeezy may collect taxes on our behalf where required by law. You are responsible for any taxes that apply to your subscription.
You can cancel a monthly subscription at any time from your account settings. We generally do not provide refunds for partial months, but we may offer a pro-rated refund at our discretion if you cancel within 7 days of a billing date and have not used the Service substantially during that period.
Annual subscriptions may be refunded within 14 days of purchase if you have not used the Service extensively. After 14 days, annual subscriptions are non-refundable, but you may continue to use the Service through the end of your billing period.
To request a refund, email us at support@visibilitykit.com from the email address on your account. Approved refunds are processed via Lemon Squeezy and typically appear within 5–10 business days.
The Service, including its software, content, design, and underlying technology, is owned by SevenHills Software and protected by copyright, trademark, and other intellectual property laws. The names "VisibilityKit" and "SevenHills Software," along with related logos, are our trademarks.
You keep ownership of any content you submit to the Service (such as brand names, domains, prompts, and competitor lists). By submitting that content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display it solely to provide and improve the Service for you.
If you send us feedback, suggestions, or feature requests, we may use them to improve the Service without any obligation or compensation to you.
To deliver our reports, VisibilityKit sends queries to third-party AI platforms (including ChatGPT, Perplexity, Gemini, Claude, Google AI Overviews, Copilot, Grok, DeepSeek, and Meta AI) on your behalf and analyzes the responses.
We do not control these AI platforms. Their availability, behavior, and outputs change over time, sometimes without notice. As a result, results may vary, and historical data points may not be exactly reproducible. We are not responsible for the content, accuracy, or availability of third-party AI platforms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
We do not guarantee that AI platforms will cite, recommend, or even mention your brand, or that using the Service will produce any particular business outcome. AI platforms decide what to say; we measure and analyze their output.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER VISIBILITYKIT NOR SEVENHILLS SOFTWARE SHALL BE LIABLE FOR:
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless VisibilityKit, SevenHills Software, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
You may cancel or close your account at any time from your account settings, or by contacting us. Cancellation does not entitle you to a refund except as described in our Refund Policy.
We may suspend or terminate your account if you:
When your account ends, your right to use the Service ends immediately. We may delete your account data within 30 days of termination, except where we are required to retain it by law or to resolve a dispute. See our Privacy Policy for more on data retention.
Before filing a formal dispute, please email us at legal@visibilitykit.com and attempt to resolve the issue informally for at least 30 days. Most issues can be sorted out this way.
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law principles.
Any dispute that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court. Each party will bear its own costs except as the AAA rules or applicable law require otherwise.
These Terms, together with our Privacy Policy, Cookie Policy, and any other legal notices we publish on the Service, make up the entire agreement between you and VisibilityKit.
If any part of these Terms is found unenforceable, the rest will remain in full effect.
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations (for example, in connection with a merger, acquisition, or sale of assets) without restriction.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or via the Service. Your continued use of the Service after the changes take effect means you accept the updated Terms.
